Terms of Service

These Terms of Service ("Terms") govern your use of the Montessori Parent Guide mobile app, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Who We Are

Montessori Parent Guide ("we", "us", or "our") provides parenting support content, AI-assisted guidance, and activity recommendations.

2. Eligibility

You must be legally able to enter into a binding agreement in your jurisdiction to use the Service. If you use the Service on behalf of another person or organization, you confirm you are authorized to accept these Terms on their behalf.

3. Nature of the Service

The Service provides educational and informational parenting support. AI-generated responses may be incomplete, inaccurate, or not suitable for your specific situation.

The Service is not medical, mental health, legal, financial, or emergency advice. Always use your own judgment and consult qualified professionals where appropriate.

If you believe a child or any person is in danger or needs urgent help, contact local emergency services immediately.

4. No Account Registration Required

Core app features do not require account registration with name, email address, phone number, or home address.

If you voluntarily contact us by email or include personal details in chat/support text, we may receive that information.

5. Subscriptions and Billing

Some features require a paid subscription purchased through Apple In-App Purchase.

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your Apple account settings.
• Refund requests are handled by Apple under Apple's policies and procedures.

We may change subscription pricing or offerings from time to time as permitted by applicable law and Apple platform rules.

6. User Content

You may provide chat text, optional child/family context, photos, and support messages ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to host, process, transmit, and use it only as needed to operate, maintain, secure, and improve the Service.

You are responsible for User Content you submit and represent that you have the rights needed to provide it.

7. Acceptable Use

You agree not to:

• use the Service for unlawful, harmful, abusive, or fraudulent activity
• attempt to reverse engineer, disrupt, or compromise the Service
• upload malware or other harmful code
• use the Service to violate others' privacy or intellectual property rights
• misuse the Service in ways that could harm children or other users

We may suspend or terminate access for violations of these Terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy:

9. AI Features and Consent

Certain features in the app require AI processing, including AI chat and room-photo analysis. These features require explicit in-app consent before AI inputs are sent for processing.

• Data categories shared: chat messages, uploaded room photos, and related context (such as child age, room type, and budget).
• Current recipient: OpenAI, L.L.C. (current AI provider).
• Purpose: to provide AI chat responses, profile-context extraction, and room-photo analysis.
• Decline/withdrawal behavior: if you decline consent or withdraw it in the app at Settings > AI Data Sharing, AI chat and room analysis remain unavailable until consent is granted again.
• Non-AI availability: non-AI portions of the app remain usable without AI consent.

Our AI provider may change over time. If it does, we will update these Terms and our Privacy Policy and refresh in-app consent where required by law or platform rules.

10. Third-Party Services

The Service relies on third-party providers (for example, Apple for payments and OpenAI, L.L.C. as the current AI provider). Their services may be governed by separate terms and policies.

We are not responsible for third-party services outside our control.

11. Intellectual Property

The Service, including its software, branding, and original content (excluding User Content), is owned by us or our licensors and is protected by applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or create derivative works from the Service.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, or specific outcomes.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from or related to your use of the Service.

To the maximum extent permitted by law, our total liability for claims arising from or related to the Service will not exceed the amount you paid (if any) for the Service in the 12 months before the event giving rise to liability.

Some jurisdictions do not allow certain liability exclusions or limitations, so parts of this section may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.

15. Termination

You may stop using the Service at any time.

We may suspend or terminate your access if we reasonably believe you violated these Terms, created security or legal risk, or misused the Service.

Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.

16. Changes to These Terms

We may update these Terms from time to time.

Your continued use of the Service after updates become effective means you accept the updated Terms.

17. Governing Law

These Terms are governed by applicable law. Mandatory consumer protection laws in your place of residence may grant you additional rights that cannot be waived by contract.
